D.C. Court of Appeals Reaffirms Constantine Cannon Victory in Law Firm Partnership Dispute
The District of Columbia Court of Appeals has reaffirmed its ruling in favor of Constantine Cannon in the law firm’s representation of partner Douglas Rosenthal against his former law firm.

The Court of Appeals denied the petition for rehearing filed by Mr. Rosenthal’s former law firm, which asked the court to change its ruling affirming the jury's verdict that Mr. Rosenthal's old firm had breached its duty of good faith to Mr. Rosenthal by failing to fairly compensate him for outstanding results, including successfully representing families of terrorist victims in a groundbreaking lawsuit against Libya and his role in successfully representing Sun Microsystems in its antitrust litigation against Microsoft. The court disposed of the petition for rehearing with an amended decision that reaffirmed the jury verdict and Mr. Rosenthal’s right to damages for the full two-year period of his last contract with his old firm. Constantine Cannon Wins Appeal in Law Firm Partnership Dispute
Constantine Cannon has won its appeal of a lower court's decision in partner Douglas Rosenthal's lawsuit against his former law firm. The District of Columbia Court of Appeals affirmed a jury verdict finding that Mr. Rosenthal's former law firm had breached its duty of good faith to Mr. Rosenthal by failing to fairly compensate him for outstanding results, including successfully representing families of terrorist victims in a groundbreaking lawsuit against Libya and his role in successfully representing Sun Microsystems in its antitrust litigation against Microsoft.

Finding that the evidence at trial supported a "sizable award of damages" to Mr. Rosenthal, the Court of Appeals reinstated damages awarded by the jury, which the trial court had improperly reduced, and even gave Mr. Rosenthal the option of seeking a new trial solely on damages. The appellate court also vacated the jury's award of counterclaim damages against Mr. Rosenthal. Click here for the decision.

Retailers receive $1.1 billion in payments from landmark debit card lawsuit settlement
On December 8, 2009, Constantine Cannon announced the payment of approximately $1.1 billion to U.S. retailers as part of the final large scale distribution of settlements funds in the 2003 class action lawsuit against Visa and MasterCard over their signature debit cards. These disbursements, which accelerated payments that were originally to be made through 2012, will bring relief to retailers during a difficult holiday season. The checks were sent to over 630,000 merchants, the vast majority of which are small businesses. The checks were also sent to cash-strapped charities, schools and state governments.

Given the size of the distribution and its importance to retailers, the payments made big news around the world. The firm's successful effort to negotiate an accelerated payment schedule and distribute the funds was noted in media outlets that include a television segment on CNBC (click here) as well as reports in the Associated Press (click here), The Seattle Times (click here) and The Am Law Litigation Daily (click here).

Constantine Cannon LLP secures third largest antitrust settlement in U.S. history for its client Discover Financial Services in its lawsuit against Visa and MasterCard. Led by Partners, Jeffrey I. Shinder and Matthew L. Cantor, Constantine Cannon (along with co-counsel) helped Discover secure a $2.75 billion settlement from Visa and MasterCard. The Discover settlement followed an August 20, 2008 ruling by the Court granting Discover partial summary judgment and denying most of defendants' dispositive motions. Mr. Cantor and Mr. Shinder were also among the lead attorneys in the Constantine Cannon team that acted as lead counsel in the In Re Visa Check class action, a case that resulted in the largest antitrust settlement in U.S. history. Ms. Cyr has been an active member of the Committee for several years and will be the second Constantine Cannon attorney to join the ABA Antitrust Section leadership.

Constantine Cannon LLP announces that, in a pro bono representation that concerned unpaid wages claims that was led by Constantine Cannon attorney, Reiko Cyr and attorneys from the Asian American Legal Defense and Education Fund (AALDEF), full judgment for the plaintiff client was awarded by the Court. That client, Mrs. Sun Ja Yi, 65, worked 60 hours a week as a chef for a popular dance club without receiving overtime or spread of hours pay. Constantine Cannon and AALDEF sued on her behalf and succeeded in obtaining both payment for her unpaid wages as well as legal fees (which were provided in full to AALDEF) in the amount of $35,000.
